Terms and Conditions
Please read these Terms and Conditions (“Terms”) before using the MTB Crew mobile app or website (together, the “Service”), published and operated by OST Studio (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Subscriptions
Some features are offered through automatically renewing subscriptions. The price, billing period, and included features are shown before you subscribe. Apple bills you through your App Store account. A subscription renews unless you cancel it before the end of the current billing period. You can manage or cancel it in Apple’s subscription settings.
Fee changes
Subscription prices may change. Any change to an existing subscription is handled through Apple’s billing process and the notice or consent Apple requires. The new price will not apply before the change takes effect under that process. You may cancel a subscription if you do not wish to continue at the new price.
Refunds
App Store purchases and refund requests are handled by Apple, subject to applicable law and Apple’s policies. You can request a refund from Apple.
Your content
The Service may let you post, store, or share ride details, reviews, photos, text, and other material (“Content”). You are responsible for the Content you submit and for having the rights needed to submit it. Your Content must not infringe another person’s intellectual property, privacy, publicity, or other rights, or violate applicable law.
You retain your rights in your Content. By submitting Content, you give OST Studio a non-exclusive license to host, store, reproduce, display, and distribute it as needed to operate the Service and according to your sharing choices. This includes making Content available to other users when you choose a sharing audience or contribute to a public trail feature. We may remove Content or restrict an account that infringes rights or violates these Terms.
Account termination and deletion
You may stop using the Service at any time. You may initiate account deletion in the app. Account deletion and associated personal data are handled as described in our Privacy Policy. Stopping use or deleting your account does not automatically cancel an App Store subscription; manage it through Apple.
We may suspend or terminate access if you materially violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should continue after termination, including ownership, disclaimers, and limitations of liability, will continue to apply.
Disclaimer
To the extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will always be available, uninterrupted, secure, error-free, or suitable for a particular purpose.
Limitation of liability
To the extent permitted by law, OST Studio and its directors, employees, partners, agents, suppliers, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising from your use of or inability to use the Service, another person’s conduct or Content, Content obtained through the Service, or unauthorized access to or alteration of your data.
Some jurisdictions do not allow certain warranty exclusions or liability limits. In those jurisdictions, these provisions apply only to the extent permitted by law and do not limit rights that cannot legally be waived.
Governing law
These Terms are governed by the laws of Florida, United States, without regard to conflict-of-law principles, except where mandatory consumer protections in your location apply. If a court holds a provision unenforceable, the remaining provisions remain effective. Our failure to enforce a provision does not waive our right to enforce it later.
Changes
We may update these Terms. If a change is material, we will provide reasonable notice before it takes effect. If you continue using the Service after updated Terms take effect, you agree to them. If you do not agree, stop using the Service and, if applicable, cancel your subscription through Apple.
